REGULATIONS TEMPORARILY POSTPONING T H E EFFECTIVE DATE O F CERTAIN OF T H E LABELING PROVISIONS OF T H E FEDERAL FOOD, DRUG AND COSMETIC ACT. Under the authority of the Act of Congress approved June 23, 1939 (Public-No. 15176th Congress), the following regulations temporarily postponing the effective date of certain labeling provisions of the Federal Food, Drug and Cosmetic Act is hereby promulgated. 5 9.01 Efective date of certain labeling provisions offht. Federal Food,Drug and Cosmetic Act temporarily postponed in certain cases. (a) The effective date of the provisions of sections 403 ( e ) (l), 403 (g), ( h ) , (i),(j)and (K), 502 ( b ) , ( d ) , (e), (g) and (h) and 602 ( b ) of the Federal Food, Drug and Cosmetic Act is hereby postponed to July 1, 1940, with respect t o any stock of lithographed labeling which was manufactured prior t o February 1, 1939, and to any stock of containers bearing labeling which, prior t o February 1, 1939, was lithographed. etched, stamped, pressed, printed, fused or blown on or in such container(1) If such stock is used by the person for whom i t was manufactured, or by a bona fide successor to the business; (2) If the quantity of such stock held by such person on January 1, 1940. exceeds 10 per cent of the total stock of such labels or containers used during the calendar year 1939; (3) If such person keeps until July 1, 1941, records showing the amount of such stock used during the calendar year 1939 and the amount on hand on January 1,1940; (4) If such person makes such records available at all reasonable hours until July 1, 1941. to any officer or employee of the Food and Drug Administration who requests them; (5) If non-compliance with the sections of the Act hereinbefore specified does not make such labeling misleading by reason of its failure t o reveal facts material in the light of representations made or suggested by statement, word, design, device or any combination thereof in such labeling, or material with respect t o consequences which may result from the use of the article to which such labeling relates under the conditions of use prescribed in such labeling or under such conditions of use as are customary or usual; and (6) If such labeling would have complied with the requirements of the ‘Federal Food and Drugs Act of June 30, 1906, as amended. (b) Notwithstanding the provisions of subsection ( a ) , such subsection shall not apply(1) To the provisions of section 502 ( d ) of the act, in so far as such provisions relate to morphine, opium, cocaine, heroin, alpha eucaine, beta eucaine, cannabis, chloral or any derivative of any such substance; (2) T o the provisions of section 502 (e) of the act, in so far as such provisions relate to alcohol, chloroform or acetanilid, or any derivative or preparation of any such substance; or (3) To the provisions of section 502 (b), (d), ( e ) , (fl,(g) and ( h ) of the act, in so far as such provisions relate to drugs to which section 505 of the act applies. This regulation shall take effect upon filing with the Archivist of the United States and REGISTER. publication of same in the FEDERAL

MYRON NILE FORD. The great grandfather of the chairman of the House of Delegates was a native of Maryland and a pioneer settler of Champaign County, Ohio. The father of the subject of this sketch moved to Marion Township, in Allen County, where Nile was born July 5, 1882. The home of young Ford, until his majority, was on his father’s farm on which a stone quarry was located. He assisted in the farm work and in preparing the stone of the quarry for the public highway. His earlier education was received in the township schools and, later, he attended Ohio Northern University at Ada. Thereafter, the young man matriculated at the Scio College of Pharmacy, of which Dr. J. H. Beal was then the dean. On completion of his college work in 1906, Mr. Ford was awarded the first prize for pharmaceutical laboratory work-membership in the AMERICAN PHARMACEUTICAL ASSOCIATION. He returned to his home county and found employment with King Brothers Drug Store in Delphos; later he accepted a position in King and Williams Pharmacy and after completing the years of apprenticeship, qualified as a pharmacist. Here he continued as manufacturing pharmacist until 1912, when he was named as secretary of the Ohio State Board of Pharmacy, which position he holds a t this time. Secretary Ford exhibits a deep interest in everything that pertains to Pharmacy, both in national and state affairs. In 1925-1926 he was honored with the presidency of the National Association Boards of Pharmacy, has been active in committee work of the A. PH.A. and has been secretary and treasurer of the Conference of Pharmaceutical Law Enforcement Officials since it was organized in 1928. Mr. Ford married Miss Goldie Mae Friedline of Delphos in 1913. Mrs. Ford died in 1920 and is survived by a son and daughter. Chairman Ford has been active in both Scottish and York Rite Masonry, is a Knight of Pythias and a member of the Methodist Church. His hobby is enjoying the home with his children, golfing and hunting. 995
