MYKROLIS–PALL PATENT DISPUTE MOVES UP A GEAR The continuing patent infringement dispute between Mykrolis and Pall over Pall’s Photokleen EZD-2 filter assembly products has taken another twist, with Mykrolis filing a request for Pall to be held in contempt of court. Mykrolis believes that Pall has defied the court’s preliminary injunction order issued on 30 April 2004 – prohibiting Pall from importing and selling a number of its photoresist filtering products or “colourable imitations thereof.” (See Filtration Industry Analyst, May 2004, page 13.) Mykrolis argues that Pall is continuing to sell its EZD-3 products, which it says are renamed versions of the EZD2 products, both of which Mykrolis believes to be subject to the preliminary injunction order. Pall is appealing the order, as Pat Iannucci, vice president of corporate communications told Filtration Industry Analyst, “we are confident that we have not violated the court’s order and welcome the opportunity to again present our case to the court. We hope that Mykrolis’s most recent action will spur the court to take action and firmly believe that the result will be in Pall’s favour.” Iannucci also disputed that the EZD-3 is simply a renamed version of EZD-2, explaining, “EZD-3 is not a renamed product. In designing it, we followed the judge’s decision in construing the claims. We have eliminated the automatic alignment feature that the judge held was required to be present in order for the claims to be infringed. Mykrolis is challenging the mechanical operation of our manifold; but it is Pall’s membrane technology
that sets Pall apart from Mykrolis.” Peter Walcott, Mykrolis vice president and general counsel, said in a statement, “we believe the actions by Pall that prompted our legal actions are very serious…as part of [our] efforts we are requesting that the court hold Pall in contempt for not acting in conformity with the preliminary injunction order.” Steve Cantor, Mykrolis director of investor relations and corporate communications told us, “the fact that we are taking this course of action against an organisation with the resources of Pall shows how seriously we view this situation.”
REDECAM GROUP GETS CASH BOOST Global investment group Henderson Private Capital has said it is to invest in the Redecam group, the filtration systems company headquartered in Italy. The group, which has a substantial presence in Italy, Spain and Australia, designs and installs filtration systems, particularly for the cement industry and the energy sector, and also has a substantial presence in the design, installation, launch, operation and maintenance of grinding mills. The investment will help Redecam in its aim of expanding into new geographic territories and industrial sectors. The investment demonstrates the confidence that an increasing number of investors and analysts have in the filtration industry. A Henderson source said in a statement, “the international nature and extent of the business, its leadership in a rapidly-growing market and its growth characteristics fit in very well with our investment criteria.” Filtration Industry Analyst spoke to Corinne Daniels of the Equus Group which
represents Henderson, and she told us, “[The new investment] will lead to greater focus on gas handling in the energy industry, as well as more modular filtration solutions for cheaper cement plants to be installed in emerging countries.” Henderson will not be directly involved in the day-today running of the business, she added.
FILMTEC EXPANDS MEMBRANE CAPABILITIES FilmTec Corp, a subsidiary of The Dow Chemical Co, plans to more than double the square footage of its existing Minneapolis membrane manufacturing plant in the US. The new facility will house additional membrane lines, new fabrication cells and will introduce further automation to the company’s production capabilities. Plant construction will begin in the third quarter of 2004. “This expansion supports our goal of offering membranes that enable the production of the highest quality water at the lowest total cost for our customers,” said Ian Barbour, chief executive officer of FilmTec in a statement. “This expansion will allow us to provide better products and shorter lead times to our growing customer base.”
