AuthenTec wins summary judgement

A

uthenTec has won a summary judgement in its patent litigation lawsuit with rival Atmel. The company announced that at the beginning of this month the US District Court of Northern California issued an order in favour of AuthenTec, ruling that its products do not infringe either of the two patents asserted in a lawsuit by Atmel Corporation. In a statement, AuthenTec vice president & general counsel Frederick Jorgensen said “From the inception of the lawsuit, we were confident our products did not infringe any of the patent claims alleged by Atmel, and we are very pleased that the court has affirmed our position through the summary judgment. We believe that our technology and intellectual property are the foundation of our market leadership, and we will defend these assets as necessary.” The summary judgment concluded that none of AuthenTec’s products infringe any of the patent claims as alleged in a lawsuit filed by Atmel in March 2006. The court also awarded AuthenTec certain costs related to the suit.

-1 Identity Solutions has announced its financial results for the first quarter ended 31 March 2008. Revenue for the first quarter of 2008 was US$116.0 million compared to US$70.0 million in the first quarter of 2007, an increase of US$46.0 million or 66%. The company also reported a first quarter net loss of US$1.9 million, or US$0.03 per diluted share, compared to a net loss of US$8.8 million, or US$0.12 per diluted share in the first quarter of 2007. Organic growth in the quarter, on a pro forma basis, increased 20% compared to the first quarter of 2007 and reflects strong demand for passport and credentialing solutions, continued growth from intelligence

service business and increases from enrolment and background screening services. During the quarter the company announced the prospective acquisition of the ID Systems business from Digimarc which is expected to close in the second half of 2008. The acquisition of Bioscrypt also closed in March. Other highlights for the quarter include the award of the US Passport Card Program by the Department of State. The company expects revenue for the second quarter of 2008 of between US$135 million and US$145 million and expects revenue for the full year ending 31 December 2008 of approximately US$555.0 million-US$575.0 million.

ockheed Martin has announced that IBM will join its industry team to develop and maintain the Next Generation Identification (NGI) system for the Federal Bureau of Investigation (FBI) – the new multi-modal, state-of– the-art biometrics system to be used by state, local and federal authorities. As the prime contractor on the FBI’s NGI program, Lockheed Martin will provide program management and oversight as well as biometric and large systems development and integration expertise. Joining the NGI team as a subcontractor, IBM will provide some information technology services, as well as specific software and hardware to be used in the NGI system. The NGI system will expand fingerprint processing capacity and will now also include palm prints, iris and facial recognition capabilities. Additionally, the system requires a significant degree of technical flexibility in order to accommodate other biometric modalities that may mature and become important to law enforcement efforts in the future. Continuing on the Lockheed Martin team are Accenture, BAE Systems Information Technology, Global Science & Technology (GST), Innovative Management & Technology Services (IMTS), Platinum Solutions and the National Center for State Courts (NCSC).

C O M PA N Y N E W S • ImageWare Systems has announced its common stock will cease trading on the American Stock Exchange (AMEX) as soon as practicable. The company believes it will be eligible for quotation on the Over-the-Counter Bulletin Board (OTCBB). In April this year ImageWare received a letter from AMEX advising that a Listing Qualifications Panel of the AMEX Committee on Securities had affirmed the decision to delist the company’s common stock from AMEX as the company failed to comply with two Sections of the AMEX company guide. • Daon has joined the Federation for Identity and Cross-Credentialing Systems (FiXs) and has accepted a position on the FiXs Board of Directors. FiXs is a coalition of commercial companies, government contractors, and not-for-profit organizations whose mission is to establish and maintain a worldwide, interoperable identity and cross-credentialing network. FiXs currently has 24 member companies, including systems integrators, financial institutions and other organizations. • Mike French has joined Sagem Morpho as a forensic expert in biometrics. French has a long experience as an IAI Certified Latent Fingerprint Examiner and serves as an editor of the Journal of Forensic Identification, publication of the International Association for Identification (IAI). He will advise and validate new applications and products for forensic, defense intelligence and civil applications. • AuthenTec has reported its financial results for the first quarter ended 28 March 2008. Revenue for the first quarter of 2008 was US$15.5 million, which was above the company’s guidance range, and represents an increase of 67% when compared to revenue of US$9.3 million in the first quarter of 2007. This also compares to US$15.7 million recorded in the fourth quarter of 2007. For the second quarter of 2008 the company forecasts revenue to range between US$17.2 million to US$17.8 million. It plans to accelerate investment in R&D to support several new product developments and other initiatives. • Atos Origin and Sagem have reportedly won a contract worth in the region of 80 million euros from the French government to produce biometric ePassports. The first biometric passports are due to be produced at the end of June.
