22 refrain from taking any action in support of a divergent policy or from making" any divergent reply to a government department or association consulting it until the joint standing committee has reported to the two Councils concerned, and those Councils have had an opportunity of considering the report or, at the request of either Council, conferring together." APPENDIX B EDUCATION ACT, 1944, SECTION 48(3)--HosPrrAL TREATMENT On June 14th, 1946, the Ministry of Education received a deputation from the Society of Medical Officers of Health, as requested by the Schocd Medical Service Group, to clarify certain matters relating to hospital treatment under Section 48(3) of the Education Act, 1944. The Society was represented by Drs. Cohen (Sheffield), Kershaw (Acc~ngtou), M o r g a n (Derbyshire),, Morrison (Derby), Newth (Nottingham), and Roberts (Swindon). D u r i n g the discussion the officials of the Ministry gave the following advice: - -
I. E~xtent o[ the Responsibility o[ a Local Education Authority. (1) If an Authority provide a type of treatment at their own clinics, hospitals should not expect the Authority to pay for such treatment at out-patient departments, though the Authority may, if they wish, supplement their own schemes of treatment by making use of facilities provided by a voluntary organisation. Similarly, where an Authority have made arrangements for inpatient treatment at hospitals, they need nor pay for children treated outside the scheme or not in accordance with those approved arrangements. A n Authority should accept financial responsibility for urgent cases such as accidents, and may do so exceptionally on the advice of the School Medical Officer in the case of pupils treated otherwise than in accordance with the approved arrangements, e , g . : - (a) pupils treated by a locum appointed by the approved surgeon or specialist; (b) pupils treated by a specialist other than the approved specialist in order to secure continuity of treatment. (2) The Dispensing of Drugs. Any drugs prescribed by the School Medical Officer should be provided free and should not be regarded as domiciliary treatment, even if the drug is to be applied by the parent at home, e.g., paraffin applied at night to a case of ichthyosis. General " j u g - a n d - b o t t l e " departments should not be set up in school clinics, but neither should t h e parents be given a prescription to be made up by the local chemmt and charged to the Authority. The Minister would welcome arrangements whereby drugs were provided by the Authority t h r o u g h dispensaries at municipal or voluntary hospitals or at dispensaries specially set up by the Authority, as has been done at Sheffield. (3) The Tubercular Child. If a tubercular child needs treatment unconnected with its condition, e.g., for defective eyesight, it may • be provided by the Local Education Authority. If, however, treatment is recommended to improve its general health and therefore to increase its resistance to tuberculous infection--as, for example, an operation for tonsils and adenoids--the treatment should be provided by the Public Health Authority. If a Public Health Authority normally make a charge to a parent for any treatment given to a tubercular child, that charge should now be met by the Local Education Authority in order t h a t . a l l treatment given to a child in a school maintaihed by t h e m should be free.
H. Contributions Between Local Education Authorities. The amendment of Section 106(5) of the Education Act, 1944, by the Second Schedule of the Education Act, 1946, makes it possible for an Authority to recover the cost of any treatment provided for a child from the areas of another Authority, e.g., when away from home on holiday. There should not be any disagreement" as to the scope of the treatment provided by the two respective Authorities, as both should have a complete scheme, particularly now that, with the clarification of the National Health Service, Authorities can proceed with definite plans. If a large n u m b e r of children in one area attend a hospital in the area of another Authority, it may be convenient for the sending Authority to make arrangements direct with that hospital. Where only a few cases are involved, it would be preferable to make the arrangements through the other Authority who would recover the cost under Section 106(5).

Arrangements With Hospitals.
(1) HostKtal Contributory Schemes. If a voluntary hospital has contracted with a parent m return for his contributions under a contributory scheme to give free treatment to his child, the hospital can have no. claim against the Local Education Authority. If the contract provides for the parent to pay a reduced fee, the Local Education Authority should relieve the parent by paying this. (2) Co-operation Between the Hospital Staff and the School Medical O0~cer. It is very desirable that, with the consent of the
specialist in charge, the S.M.O. should periodically visit the hospitals used by the Authority, although this could hardly be made a condition of using the hospital. Authorities m i g h t well, however, insist on receiving a report on each child on its discharge. If made to the S.M.O. instead of to the Director of Education, no breach of professional etiquette could arise• The School Medical Officer should always be able to discuss with the specialist dealing with the child in hospital. (3) Circular 102. A l t h o u g h arrangements already approved at rates in excess of those set out in this Circular may stand, it is open to an Authority to apply for revision under paragraph 7. Payments under paragraph 5(i) were to particular consultants specially appointed and mainly for specialised treatment, such as refractions or orthopaedic cases, while paragraph 5(ii) referred to the visiting medical staff. (4) Convalescent Homes were not a party to the agreement with the British Hospitals Association and were not covered by the Circular. Authorities need not ask for approval in each case, but should give particulars on Form 9M of the arrangements which they propose to make with convalescent homes, setting out the range of fees (highest and lowest only). Reasonable charges would be recognised for grant. The Authority should satisfy themselves that the homes proposed to be used were suitable as they were not inspected by the Ministry. Children who are likely to need treatment for more than four weeks should be sent to a special school.

The Hon. Secretary's report for the past session is as follows:--(1) Membership.--The Membership of the Branch is now 230. (2) Meetings.---During this period the Council has held one meeting, and the Branch has met ten times, five meetings being joint ones with the Home Counties Branch. (3) Resignation of Treasurer.--Dr. James Fenton, the Treasurer of the Branch, resigned during the year on his appointment as Treasurer of the Society of Medical Officers of Health, and Dr. A. J. Shinnie was appointed in his place. (4) Special Matters.--We regret to announce the death during the year of Dr. Vynne Borland, Medical Officer of Health of Bethnal Green, formerly Secretary of this Branch. The Dental Officers' Group was originally the School Dentists' Society, which was founded in 1898 by a few pioneers of school dentistry. It is the oldest society concerned primarily with the welfare of the public dental officer and amongst its past presidents are found the names of J. Sire Wallace, Evelyn Sprawson, George Thomson, Grantley Smith and Frederick Breese, to mention only a few. In 1921, after 23 years of service both to the profession and to the public, the School Dentists' Society amalgamated with the Society of Medical Officers of Health, thereby forging the only direct political and academic link between the medical and dental professions, the value of which cannot be overstressed. This year marks the silver jubilee of this profitable union and in view of the imminence of important developments in the Public Health Service the Group Council has decided to endeavour to increase the membership to include if possible every dental officer in the country. Meetings.--Frequent meetings of the Group are held in London on matters relating to public de~atistry from the administrative, clinical and preventive aspects. In addition provincial meetings are occasionally held and also joint meetings with other Groups and Branches of the Society. To illustrate the Group's work in this sphere meetings have recently been held on the following subjects : - " T h e Technique of Lecturing to Lay Audiences." By Dr. Robt. A Discussion on the NationM Health Service Bill. Opened by J. Fletcher, L.D.S. It will thus be seen that the subjects chosen for discussion were of considerable interest to dental officers. At such meetings they are able to meet their colleagues and to discuss with them problems of mutual interest. The benefits to be derived from such interchange of experience cannot be too strongly emphasised. Sub-groups.~Before the war Sub-groups were in existence in Yorkshire, South Wales, North-West England and the Metropolitan and Home Counties area. Active preparations are being made to revive the activity of these and other projected Sub-groups throughout the country. S~agaries.--In 1935 a conference on salaries was arranged on the initiative of the Group between the Society of Medical Officers of Health, the British Medical Association and the British Dental Association at which agreement was reached embodying the British Dental Association 1928 Scale of Salaries for Dental Officers. But unfortunately at that time formal acceptance of that scale was not obtained from the employing authorities. Following the recent decision to give notice to terminate the Askwith Agreement on Medical Salaries the Society appointed a sub-committee to draw up a new scale of salaries and a representative of the Group attended with a view to including dental officers' salaries in any future agreement. T h e advent of the National Service Bill and the Spens Committee on the remuneration of medical practitioners further delayed matters but the Society is giving every support to
