B o r o u g h S a n a t o r i u m a n d D e p u t y Medical Officer of H e a l t h for Brighton. Dr. L e c k y was a m a n of u n u s u a l ability, h i g h character, a n d c h a r m i n g personality. He was devoted to his work, and, h a d he lived, he would n n d o u b t e d y have occupied a d i s t i n g u i s h e d position m the p u b l i e h e a l t h service. W h e r e v e r he went he m a d e friends, who will l o n g cherish his memory. F r o m a m e d i c a l friend who k n e w Dr. L e c k y well at B r i g h t o n comes this t r i b u t e : - - " I n the short time we h a d k n o w n h i m at B r i g h t o n we h a d come to love him. His b r i g h t n e s s , unselfishness, a n d u n f a i l i n g courtesy and k i n d n e s s to a l l compelled affection. I never h e a r d h i m say a w o r d I w o u l d have w i s h e d unsaid, and never saw h i m do a t h i n g I would have wished undone. His m o d e s t y was almost a source of weakness, so over-anxious was he always not to h u r t another's feelings. I cannot recall a n o t h e r character quite like h i m . " Dr. L e c k y was an occasional c o n t r i b u t o r to P~rBLIC HEALTH, and an article from his pen on Calmette's T u b e r c u l i n O p h t h a l m i c Reaction appeared in the A p r i l n u m b e r . T h i s was his last c o n t r i b u t i o n to a m e d i c a l journal. H i s u n t i m e l y death is a sad e n d i n g to a career of g r e a t usefulness a n d g r e a t e r promise. A n inspector under the sale of Food.& Drugs Acts, directed his assistant to procure a sample of milk in course of delivery, which he did. The inspeetor sent the sample f o r analysis, and instituted proceedings under the sale of Food & Drugs Act, 1879, Sec. 3. I t was held that he was entitled to do so, although the assistant could himself have proceeded under the Act. T h i s was a c~se stated b y j u s t i c e s of Middlesex, on the h e a r i n g of an i n f o r m a t i o n b y W a l t e r Tyler, a n i n s p e c t o r of w e i g h t s a n d measures, a n d also an i n s p e c t o r u n d e r the Sale of F o o d a n d D r u g s Acts,

The information a l l e g e d that he did procure at, the place of delivery a certain s a m p l e of m i l k in com'se of d e l i v e r y b y the D a i r y S u p p l y Co., L i m i t e d , to the g u a r d i a n s of the poor of t h e Brentford Union, the p u r c h a s e r s or consignees in pursuance of a contract for the sale to the said g u a r d i a n s of the Brentford Union, such pro'chasers or consignees of such milk, and that s u s p e c t i n g the same to have been sold b y the r e s p o n d e n t s c o n t r a r y to the provisions of the Sale of F o o d and D r u g s Acts 1875 to 1899, the a p p e l l a n t d i d s u b m i t t h e same to be analysed b y the p u b l i c analyst, when the same was found to have been u n l a w f u l l y sold b y the respondents, c o n t r a r y to the provisions of the said Sale of Food and D r u g s Acts, i n a s m u c h as it h a d been d e p r i v e d Of fat to the extent of 9 per cent,., w i t h o u t disclosure h a v i n g been p r e v i o u s l y m a d e of such alteration. The s a m p l e in question was t a k e n b y one A n d e r s o n , an assistant inspector of weights a n d m e a s u r e s for Middlesex, on T y l e r ' s instructions, b u t T y l e r was not present. T y l e r sent the s a m p l e to be a n a l y s e d and i n s t i t u t e d proceedings u n d e r the Sale of F o o d and D r u g s A m e n d m e n t Act, 1879, See. 3, w h i c h is as follows. It was contended on b e h a l f of the Dairy Company, that as the s a m p l e was actually taken b y Anderson. a d u l y qualified, t h o u g h an assistant inspector, the proceedings o u g h t to have been taken b y him. The justices b e i n g in d o u b t dismissed the information. Eustaee Hills a p p e a r e d for the appellant, Avory K.C.. and Clarke Hall for the respondent. The court allowed the appeal. L o r d Alvers~one in t h e course of his j u d g m e n t said t h a t a n inspector could procure a s a m p l e u n d e r Section 3 of the Act of 1879, b y a p r o p e r agent. It had been h e l d in Horder v. Scott, 5 Q. B.D. 552. that an officer m i g h t act b y ' d e p u t y in t a k i n g samples u n d e r Section 13 of the Act of 1875, a n d there seemed no reason w h y t h a t decision should not a p p l y to this ease. A n d e r s o n here took the s a m p l e as agent for Tyler, a n d as T y l e r sent it for analysis he was the p r o p e r person to take proeeedings. T h e a p p e a l was therefore allowed/ A. T.
